1. Agreement and service scope
These terms apply to this website and to services purchased from Boreal Growth Co. A written proposal, statement of work or service agreement may add project-specific terms. If project-specific terms conflict with these general terms, the project-specific terms control for that project.
2. Services and delivery
We provide lead-generation, website creation and website design services. The exact deliverables, schedule, client responsibilities, fees and delivery method will be stated in writing before paid work begins. Services and deliverables are generally supplied digitally.
3. Client responsibilities
You agree to provide accurate information, timely feedback, necessary access and content you have the right to use. You remain responsible for your business operations, customer follow-up, service claims, regulatory compliance and final approval of published materials.
4. Fees and payment
Fees, taxes, payment dates and any recurring charges will be disclosed in the applicable proposal, agreement, invoice or checkout before payment. Overdue work may be paused. Third-party costs such as advertising, domains, hosting, software or stock assets are the client’s responsibility unless expressly included in writing.
5. Changes and acceptance
Requests outside the agreed scope may require a revised timeline and additional fee. Deliverables will be reviewed according to the acceptance and revision process stated in the project agreement. If none is stated, the client should report material defects within seven calendar days of delivery.
6. Ownership
Each party keeps ownership of materials it owned before the project. Unless otherwise stated in writing, final client-specific deliverables transfer to the client after all related invoices are paid, excluding our reusable methods, tools, templates, licensed components and know-how. Third-party materials remain subject to their licences.
7. Marketing results
We do not guarantee search rankings, lead volume, sales, revenue or other specific business results. Outcomes depend on factors outside our control, including market demand, competition, advertising platforms, budgets, client responsiveness and the services offered by the client.
8. Acceptable use
You may not use this website or our services for unlawful, deceptive, abusive or infringing activity, or to interfere with the security or operation of any system.
9. Limitation
To the fullest extent permitted by law, Boreal Growth Co. is not liable for indirect, incidental, special or consequential losses arising from this website or the services. Any direct liability will not exceed the amount paid for the specific service giving rise to the claim. Nothing in these terms limits rights or remedies that cannot legally be excluded.
10. Ending services
Either party may end an engagement as permitted by its project agreement. Amounts owing for completed work, approved expenses and non-cancellable third-party commitments remain payable. Refund eligibility is described in our Refund Policy.
11. Governing law and contact
